This page consolidates the disclaimers that apply to the Coinfig website and the Coinfig Service (together, "Coinfig"), and serves as an overview of, and index to, our other legal documents. It is published by Silver Sixpence (Pty) Ltd ("Sixpence", "we", "us").
This Disclaimer supplements and does not replace the documents listed in section 2. If there is any conflict between this Disclaimer and our Terms of Use, the Terms of Use govern.
2) Our legal documents at a glance
Coinfig is governed by four documents. Together they cover the contract you enter into with us, how we handle your personal information, how we use cookies, and what you may and may not do on the Service:
- Terms of Use — the agreement governing your use of Coinfig: eligibility, accounts and sign-in, data sources and API keys, fees, renewals and refunds, what Coinfig is and is not (section 3), permitted reliance on reports and calculations (section 12), privacy and POPIA commitments (section 14), and liability limitations (section 15).
- Privacy Notice — how we collect, use, share, store, and protect personal information under POPIA, including where data is hosted, how long we retain it, and your rights as a data subject.
- Cookie Policy — the cookies and similar technologies we use, why we use them, how long they last, and the choices and controls available to you.
- Acceptable Use Policy — the rules for lawful use of Coinfig, prohibited activities, your data-integrity responsibilities, and how we enforce the policy. It is binding on all users under section 8 of the Terms of Use.
3) No tax, legal, financial or investment advice
Coinfig is a calculation and reporting tool. It does not provide tax advice, legal advice, financial advice, or investment advice, and nothing on this website or in the Service should be treated as such.
Reports and outputs generated by Coinfig are supporting documents only. They are not a substitute for advice from a qualified tax practitioner, and they are not audit opinions, assurance reports, or SARS submissions. Coinfig is not endorsed by, or affiliated with, SARS, and does not file or submit returns on your behalf. This is consistent with, and does not limit, sections 3.2 and 12 of our Terms of Use.
4) Risk Disclosure
Cryptocurrency prices are highly volatile. Capital invested in crypto assets is at risk, and you may lose some or all of its value.
Coinfig's calculations and reports describe historical tax outcomes based on transactions that have already occurred. They do not account for investment risk, and nothing on this website or in the Service is a recommendation to buy, sell, or hold any crypto asset.
Past performance, historical prices, and historical tax outcomes are not an indicator of future results.
5) Accuracy and currency of information
To the maximum extent permitted by law, and without limiting any right that cannot lawfully be excluded, the content of this website and the outputs of the Service are provided "as is", without warranty of accuracy, completeness, or currency. Website content, including descriptions of features, jurisdictions, and tax rules, may not always reflect the latest legislative or regulatory changes.
The accuracy of any report generated by Coinfig depends on the completeness and correctness of the data you import, upload, or connect, and on the classifications and assumptions applied to that data. Any reliance you place on information on this website, or on outputs of the Service, is strictly at your own risk. This is consistent with, and does not limit, section 15.1 of our Terms of Use.
6) Data handling and privacy
To produce tax calculations, Coinfig processes personal information such as names, identity and tax numbers, wallet addresses, transaction histories, and the classifications and settings you apply to your data. We process this information in line with POPIA, and data is hosted in South Africa.
How we collect, use, share, secure, and retain personal information — and how to exercise your rights, including requesting export or deletion of your data — is set out in our Privacy Notice and section 14 of our Terms of Use. Our use of cookies and similar technologies is set out in our Cookie Policy.
7) Third-party data and links
Market prices, exchange data, and other information sourced from exchanges, wallets, pricing providers, or other third parties are provided by those third parties. We do not control, and do not warrant the accuracy, completeness, or availability of, that third-party data.
This website may link to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party website.
8) Limitation of liability
Our liability in connection with this website and the Service, including the excluded categories of loss and the applicable liability cap, is set out in full in section 15 of our Terms of Use. This Disclaimer does not expand our liability beyond what is set out there.
